RENTAL AGREEMENT TERMS AND LIABILITY WAIVER
This Agreement is between you (the "Client") and WOW Strollers, LLC ("WOW"). WOW remains the sole owner of all rental equipment. WOW is not offering the equipment for sale, and the Client is not purchasing it. The Client acknowledges that the equipment is for personal use only. By signing and accepting the terms and conditions of this rental agreement, the Client confirms that they have read, understood, and agreed to the terms stated below. Please read the entire agreement carefully.
Reservations and Payment of Rental Fees
- Reservation Confirmation: The Client's reservation is incorporated by reference and will be confirmed by email within 24 hours. If confirmation is not received within this timeframe, the Client should contact WOW.
- Payment Terms: Payment is due by credit or debit card at the time of reservation. WOW reserves the right to make necessary adjustments to the form of payment for crediting, refunding, or charging any service or fee associated with the reservation. If the payment form fails or is not processed correctly, the Client will be notified and is responsible for providing an alternative payment method promptly.
- Product Variability: The colors and brands of rental products may vary from the images shown.
Delivery, Possession, and Usage
- Delivery Details: At the time of reservation, the Client must specify the name and location of the Orlando area resort, hotel, or vacation home for delivery and retrieval of rental items. Delivery and return locations and procedures may vary based on the chosen location. Delivery/return times will be communicated via email. Any changes to delivery details must be communicated to WOW as soon as possible. Last-minute changes may incur additional charges.
- Contact Requirements: All deliveries and pick-ups at Disney resorts must be conducted in person with one of our team members. The Client agrees to contact WOW within 2 hours of the agreed delivery/return time if unable to meet a WOW representative. Late or missed appointments may result in rescheduling at WOW’s discretion.
- Delivery Window: If delivery is missed or delayed due to reasons beyond the Client’s control, WOW will work with the Client to reschedule.
- Redelivery Fee: A $15 redelivery fee may be applied at WOW’s discretion if a second trip is required due to an incorrect delivery location or client unavailability.
- Early Return Notification: Clients must notify WOW if returning rental items earlier than the agreed date. Failure to notify will void any insurance.
- Extension Requests: Clients must contact WOW before the return time to request an extension. Extensions are subject to availability and approval, with a $10 charge per additional day or fraction thereof.
- Return Trip Fee: A $20 fee may be applied for return trips if items are not returned at the agreed time. Items must be returned to the bell stand or front desk and not left in rooms or vacation homes unless prearranged.
- Product Change Requests: Changes to the product due to size or transportation issues are subject to availability and a $10 fee per item.
Damages to or Loss of Equipment
- Client Responsibility: The Client accepts full responsibility for the care of rental items and agrees to pay for any loss, theft, damage, or destruction. Replacement costs for items not returned within 48 hours of the agreement’s end will be charged to the Client’s credit card. Clients are encouraged to inspect the equipment upon delivery and report any pre-existing damage immediately.
- Replacement Costs: The Client is responsible for the replacement cost of lost or damaged parts or accessories, including but not limited to shoulder straps, harnesses, parent consoles, rain covers, cooler bags, and glider boards.
- Key Replacement Fee: A $50 replacement fee will apply if a power scooter charger or key is lost.
- Reporting Damages: Any damages or loss should be reported to WOW immediately. Clients should detail the incident and cooperate with WOW in assessing the damage.
Cancellation
- Refund Policy: Full refunds are given for cancellations made 24 hours or more before the rental date. Cancellations within 24 hours will incur a minimum rental fee of $45. Exceptions to this policy may be made in cases of unforeseen circumstances such as natural disasters or emergencies, at WOW's discretion.
Liability Waiver
- Assumption of Risk: By accepting and using the rental equipment, the Client and any user acknowledge that the equipment is used at their own risk. WOW makes no warranties with respect to the equipment and disclaims all warranties, express or implied.
- Hold Harmless: WOW, its employees, owners, and affiliates are not responsible for accidents, injuries, or damages caused by the use or misuse of the rental equipment. The Client agrees to hold WOW harmless from any liability, injury, death, property loss, or damage resulting from the use of the equipment.
- Governing Law: This Agreement is governed by the laws of the State of Florida.
- Insurance Coverage: The Client acknowledges that they were offered the opportunity to purchase insurance for the rental equipment. Insurance coverage is subject to the terms and conditions outlined in the agreement. Insurance covers damage to the equipment but may exclude some forms of negligence or misuse. Clients should review the insurance terms carefully.
- Dispute Resolution: Any disputes arising from this agreement will be handled in accordance with Florida law. Mediation or arbitration may be offered as an alternative to court proceedings to resolve disputes amicably.
Data Privacy
- Client Information: WOW Strollers values your privacy. Client information collected during the rental process will be used solely for the purpose of fulfilling the rental agreement and will not be shared with third parties without your consent, except as required by law.
Emergency Contact
- Emergency Procedures: In the event of an emergency related to the rental equipment, the Client should contact WOW immediately. WOW will provide guidance and support to resolve the issue as quickly as possible.
